1. Personal Data We Collect or Process

(a)The Services capture some information about you automatically utilizing background local storage and session storage technologies (“Cookies”). Cookies are small files or other pieces of data which are downloaded or stored on your computer or other device, that can be tied to information about your use of the Services (including certain third-party services and features offered as part of our Website). Examples of information of this type are your IP address, the browser you are using, the operating system you are using, the pages on the Website that you visit and details of your transaction activity. When we use Cookies, we may use “session” Cookies that last until you close your browser or “persistent” Cookies that last until you or your browser delete them. You may change your browser setting to decline the use of Cookies.

We use Google Analytics, a web analytics service of Google LLC. which uses Cookies to identify the frequency of use of certain areas of our Website and to identify preferences. The information regarding your use of our Website that is generated by the Cookie (including your truncated IP address) is transferred to a Google server in the United States and stored there. Google will use this information to analyze your use of the Services, compile reports on activity for us, and perform further services associated with website use and Internet use. Google may also transmit this information to third parties where required by law or to the extent that third parties process these data on behalf of Google. Analytics and advertising Cookies and your choices. If you are visiting from the European Economic Area, the United Kingdom or Switzerland, we do not activate Google Analytics or advertising storage unless you have given consent for the corresponding category. You can review or change either choice at any time from the Cookies settings link in the footer of our Website. Withdrawing analytics consent stops analytics collection from that point on and removes the analytics Cookie described below.

If you enable the Advertising category, Google advertising services may store or access advertising Cookies and use data from your visit to measure paid campaigns and personalize advertising. If you leave that category off, we send the denied advertising-consent signals to Google and those services must operate without advertising storage, advertising user data, or personalized advertising. Your Analytics and Advertising choices are separate.

The “ss_uid” Cookie.When you are signed in to an account on our Website and analytics consent has been given, we set a Cookie named “ss_uid”. Its value is a SHA-256 hash of your email address rather than the address itself. A hashed email address is still personal data — it identifies you consistently from one visit to the next even though it cannot be read back as an address — and we treat it as personal data. Its only purpose is to let our analytics recognize that separate visits belong to the same signed-in person, so that we can understand how the Website is used over time. We do not send it to Google as advertising user data or share it directly with advertisers.

The “ss_uid” Cookie lasts 30 days and is refreshed each time you visit, so it expires 30 days after your last visit. We delete it when you sign out and when you withdraw analytics consent. It is not set at all for visitors who are not signed in, or where analytics consent has not been given. You can also delete it yourself at any time through your browser settings.

The Cookies and browser storage we use. The table below names each Cookie and similar item of browser storage the Website uses, what it is for, how long it lasts, and whether we set it or a third party does. Where an entry depends on a consent category, it is not stored unless that category is in effect for you.

Pixel Tags or Clear GIFs, also known as Web Beacons or Web Bugs, are transparent graphical images placed on a website. We use these items on our Website to permit us, for example, to count users who have visited those pages or opened an email and for other related statistics regarding use of our Website (for example, recording the popularity of certain content and verifying system and server integrity).

We operate social media pages on third-party networks and have social media icons on our Website. When you visit or link to our social media pages, data is processed both by us and the applicable social media provider. Social media providers are unaffiliated with us, and we are not responsible for the content or privacy practices of social media providers. Social media providers have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites or interact with their platforms.

Advertising displayed on our Website is sold directly by us to advertisers and sponsors, and is placed according to the content it appears alongside. We do not use third-party advertising networks, ad exchanges or programmatic advertising to serve advertisements on our Website. Separately, we may use Google advertising services to advertise Showsight on other websites and measure those paid campaigns, subject to the Advertising choice described above.

When you click on a link that is provided by a third party or available in an advertisement, data is processed both by us and the linked site. Linked sites are unaffiliated with us, and we are not responsible for the content or privacy practices of the operators of such linked sites.

(b) We (or our service providers) also collect information that you provide to us or to our service providers voluntarily, such as in the following situations:

• When you sign up to receive newsletters, announcements and invitations;
• When you register for contests and giveaways;
• When you subscribe to our publications;
• When you create an account with us;
• When you submit user content, such as in connection with a “Claim Your Dog” page or a directory listing
• When you contact us;
• When you request a media kit;
• Enter into contracts for advertising.

We may ask for your name, email address, physical address, phone number, username, password, profile picture, and, if you are making a purchase, payment card information.

If you purchase a directory listing, we may ask, in addition, for your company, title, website, a description of your product or service, biographical data, and testimonials.

If you request a media kit, we may ask in addition, for your company, title, website, a description of your product or service, the type of advertising you are interested in, and details about the advertising campaign (launch date, duration and budget).

If you contact us, we will have access to the information you provide in the transmission.

We utilize third party service providers to process your payments. To the extent you are redirected to those providers’ user interfaces, information may be provided directly to such providers via our Website, and accordingly we may receive information about you from those providers in connection with your transactions on our Website.

(c)We do not knowingly collect information from users of our Website under the age of 18 and/or their internet usage, and such persons are not authorized to use the Services. If we obtain actual knowledge that a user is under 18, we will take steps to remove that user’s personal information from our databases. By using the Services, you represent that you are at least 18 years old and that you are of legal age to enter into legal agreements, or if you are not, that you have obtained your parent’s or legal guardian’s consent to accept the terms in this Privacy Policy.

2. How We Use the Data

We use the personal data we collect for the following purposes:

3. With Whom We Share Personal Data

When you submit user content, such as in connection with a directly listing and a “Claim Your Dog” page, your information may be visible to visitors to our Websites and other registered users.

Delta Digital House shares information with third parties that perform services on our behalf, including without limitation our hosting provider, payment processor, publishers, email and mail delivery service providers and professional advisors. The service providers below each support a feature you can see and use on the Website, and each of them processes personal data under its own privacy policy in addition to our agreement with them:

• Vercel hosts the Website and delivers every page you request. As the host it necessarily processes your IP address, the pages you request, and the contents of requests you send us, including anything you type into a form. See the Vercel Privacy Policy.
• Resenddelivers the transactional and notification email we send on our behalf, including replies to enquiries, media kit requests, advertising and order notifications, and messages generated by the forms on the Website. It receives the recipient’s name and email address and the full content of the message, including any files attached to it. See the Resend Privacy Policy.
• Stripeprocesses every payment, subscription and free trial on our behalf, including one-off magazine orders, directory listings, “Claim Your Dog” pages, magazine subscriptions and advertising insertion orders. Stripe receives your payment details, billing name and address, email address and purchase history, and also uses that data to detect and prevent fraud. See the Stripe Privacy Policy.
• Cloudflare Turnstile checks that the person submitting a public form is not an automated script. It receives your IP address and signals about your browser and device. See the Cloudflare Privacy Policy.
• Sentry records technical errors so we can fix them. An error report can include your IP address, the page you were on, your browser and device details and, if you are signed in, your account identifier. See the Sentry Privacy Policy.
• Dropbox stores advertising artwork and photographs that advertisers upload for an insertion order. Files you upload for an order go directly to Dropbox. See the Dropbox Privacy Policy.
• Bunny delivers the videos on the Website. It receives your IP address and playback requests in order to stream video to you. See the Bunny Privacy Policy.
• Google Maps renders the maps shown on directory listings, which involves sending your request for the map, including your IP address, to Google.
• Google Tag Manager is the container we use to load and manage the tags described in this Policy, including Google Analytics. It receives your IP address as part of loading, and it respects the consent choices described in Section 7.

Google’s handling of the data it receives through Google Maps, Google Tag Manager and Google Analytics is described in the Google Privacy Policy.

Payment card details never reach us. When you make a purchase, your card number, expiry date and security code are entered into a payment page hosted by Stripe and are transmitted directly to Stripe. We do not receive, process or store your payment card information, and Stripe processes it as an independent controller under its own privacy policy. What we keep is an electronic receipt as described in Section 6.

We have relationships with third parties, including those of our advertisers. If you opt in to receive communications from third parties when you sign up on our Website, we may provide them some personal information such as your name and email so that they may contact you about products or promotions you may be interested in.

When you click on a link that is provided by a third party or available in an advertisement, your data may be shared with the linked site, and Delta Digital House may receive a commission in connection with your navigation to and activity on such linked sites.

If you opt in to mobile messaging, we will use information you provide to transmit your mobile messages and respond to you, if necessary. This includes sharing information with platform providers, phone companies, and other third-party service providers who assist us in the delivery of mobile messages. As with all information collected by us, we reserve the right at all times, to the extent permitted by law, to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property.

We may disclose information if we have a good faith belief that disclosure is necessary by law or the legal process, to protect and defend our or others’ interests or property, or to enforce agreements you enter into with us.

We may share your data with a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock with such third party.

We may share aggregated and de-identified information with third parties (within or outside your country of residence) for analytical, research or other similar purposes.

Delta Digital House may obtain your written consent from time to time in electronic form by using online agreements or other acknowledgements on the Services, including for any other contemplated uses of your personal data not addressed in this Privacy Policy. Please read all online agreements carefully before accepting them.

4. Text Messaging

We may use your mobile number for authentication purposes. We may send you service-related announcements when it is necessary (for example, if we must temporarily suspend our service for maintenance). Also, you may choose to receive promotional texts from us based on preferences that you indicate. We may offer mobile messaging, where, if you opt in, you agree to this Privacy Policy and to receive text messages from us. Participation in mobile messaging is optional and not a condition of purchase. The messages we send to you may include marketing messages and service-related communications. Messaging frequency may vary. You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.

Regardless of the opt-in method you utilized to participate in mobile messaging, you agree that this Privacy Policy applies to your participation in mobile messaging. By participating in mobile messaging, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”). Message and data rates may apply. Please consult your mobile service carrier’s pricing plan to determine the charges for browsing data and sending and receiving mobile messages. Under no circumstances will we be responsible for any messaging or wireless charges incurred by you or by a person that has access to your wireless device or telephone number.

SMS/MMS Mobile Messaging Opt-Out: If you do not wish to continue to receive mobile messages, please reply STOP to any mobile message from us in order to opt out. You may receive an additional mobile message confirming your decision to opt out.

5. Grounds for Using Your Personal Data

We rely on the following legal grounds to process your personal information:

Consent. Some uses of your personal data as described in this Privacy Policy are subject to your consent, such as marketing email communications.

Performance of a contract. We may need to collect and use your personal information to enter into a contract with you and to perform Services that you request.

6. Storage and Protection of Your Personal Data

We retain the personal data we collect for so long as reasonably necessary to fulfill the purposes for which the data was collected and to perform our contractual and legal obligations. Notwithstanding the generality of the foregoing, we store email addresses until the user requests to be unsubscribed or removes themselves through any self-service tools offered to the user. We do not store payment card information; rather we utilize a third party payment processor and store only an electronic receipt that sets forth confirming payment details, such as purchase date, the expiration date of the payment card and the payment ID, but not complete payment card information.

We take reasonable administrative, physical and technical precautions to protect your personal data and communications between us. This includes, when required or as we deem appropriate and feasible under the circumstances, encryption and written commitments from third parties that may have access to your data that they will protect the data with appropriate safeguards.

No Internet or e-mail transmission is ever fully secure or error free, however. We therefore cannot guarantee absolute security of your data, and we are not responsible for processes and networks that we do not control. Users assume the risk of security breaches and the consequences resulting from them. Please be careful in deciding what information you send to us via email or over the Internet.

7. Your Rights, Choices and Disclosures

(a) General. This section is subject to specific disclosures on privacy rights set forth below. We are committed to facilitating the exercise of your rights granted by the laws of your jurisdiction, which may include the right to request the correction, modification or deletion of your personal information and the right to opt out of the sale or sharing of your personal information. We will do our best to honor your requests subject to any legal and contractual obligations. California “Shine the Light” Information-Sharing Disclosure: California residents may request a list of all third parties with respect to which we have disclosed any information about you for direct marketing purposes and the categories of information disclosed. Global Privacy Control and Do Not Track Disclosure:Your browser or a browser extension can send a Global Privacy Control (GPC) signal on your behalf. We utilize an automated tool designed to recognize GPC signals in end-user browsers and treat them as opt-out requests. The tool is designed, upon detection of the GPC signal, to switch off the Analytics and Advertising categories before any analytics or advertising tag loads, wherever in the world you are visiting from. A choice you make yourself on this Website takes precedence over the signal, so if you decide to turn either category back on using the cookie settings link in the footer, that decision is respected and your stored choice continues to apply on later visits. You can clear that stored choice at any time by deleting this Website’s Cookies, after which the signal applies again.

We do not respond to Do Not Track browser signals. Unlike Global Privacy Control, Do Not Track has no common industry standard defining what a website must do when it receives one, so we cannot tell you what honoring it would mean in practice, and we do not claim to.

Any sensitive data we collect is used only for a business purpose and not for the purposes of inferring characteristics of a consumer.

In the last 12 months preceding the effective date of this Privacy Policy, we have shared (as defined under CCPA) consumers’ personal information in the context of cross-contextual behavioral advertising.

We do not sell personal information. When the Advertising category is enabled, we may disclose online identifiers and activity information to Google to measure paid campaigns and personalize advertising; this may be considered “sharing” for cross-context behavioral advertising under the CCPA. You can opt out at any time through the Cookies settings link in the footer or by using a browser that sends a Global Privacy Control signal.

For users who opt in to receiving third party marketing communications when they sign up on our Website, we provide some of your personal information such as your name and email address to third parties for their direct marketing purposes. Personal data may be provided to our service providers, contractors, and, pursuant to Sections 1798.140(ad)(2)(A) and 1798.140(ah)(2)(A) of the CCPA, to third parties.

If this information or these processes are insufficient to verify your identity and assess your privacy request, we may need to ask for additional information. You may also designate an authorized agent to make a CCPA privacy request.

8. Users Outside the United States

The Services are controlled and operated from the United States. If you are an individual from the European Union, Canada or any other jurisdiction with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that your personal data may be transferred to, and stored in, the United States which is not deemed an “adequate jurisdiction” by the European regulatory authorities.
